General Terms of Sale and Services

1. Legal identification and contact details

KnownAndSeen is the trading name under which Touili Mohammed provides professional press release writing, editorial preparation, distribution and reporting services. In these General Terms, “KnownAndSeen,” “we,” “us” and “our” refer to the service provider, while “Client,” “you” and “your” refer to the person or organization purchasing the service.

2. Purpose and acceptance

These General Terms of Sale and Services define the rights and obligations of KnownAndSeen and the Client in connection with the services purchased through our website. By placing an order, you confirm that you have read and accepted these Terms, our Refund Policy and our Service Delivery Policy.

You must be at least 18 years old and legally able to enter into a binding agreement. If you purchase on behalf of an organization, you confirm that you are authorized to bind that organization.

3. Our services

Depending on the package purchased, KnownAndSeen may provide press release writing, editing, formatting, editorial preparation and distribution through selected third-party networks. Following distribution, we provide a PDF statistics report, direct live links for confirmed publications and instructions for using the traffic-tracking method available for the campaign.

The exact deliverables, price and estimated delivery period for your order are those displayed on the applicable package page at the time of purchase and confirmed in your order receipt.

4. Order process

1. You select and pay for a package. Once payment is successfully confirmed, an order confirmation email containing your invoice is sent instantly and automatically to the email address provided at checkout.
2. A member of our team contacts you by email and WhatsApp within 30 to 60 minutes after payment to collect the information, company details, quotations, links and media needed for the release.
3. You may provide a completed press release or request writing assistance based on the information you submit.
4. We prepare or review the content and send it to you for final review.
5. You approve the final version before it is submitted for distribution.
6. Within the applicable delivery period, we provide a PDF statistics report, direct live links for every confirmed publication and instructions for accessing the available traffic-tracking method.

5. Prices, payment and taxes

Prices are displayed in United States dollars unless another currency is expressly shown at checkout. Package purchases are one-time payments and do not create a recurring subscription unless this is clearly disclosed and separately accepted before payment.

Payments are processed securely by Stripe or another payment provider displayed at checkout. KnownAndSeen does not directly store complete payment-card details. Applicable taxes, if any, may be added or displayed during checkout.

You agree to provide accurate billing information and authorize the payment provider to charge the amount shown before you confirm the purchase.

Once payment is successfully confirmed, an order confirmation email containing your invoice is sent instantly and automatically to the email address supplied at checkout.

6. Information and cooperation required from you

Delivery depends on receiving complete and accurate information from you. You are responsible for responding to reasonable requests, reviewing drafts and providing approval or revision instructions without undue delay.

The delivery period begins only after we receive all required information, you approve the final press release and the release is submitted for distribution. Delays caused by missing information, delayed responses or requested changes may extend the delivery period.

7. Review, revisions and final approval

You must review names, dates, quotations, links, claims, contact details and other factual information before approval. The number or scope of revisions included is determined by the package purchased or the written order confirmation.

Your final approval confirms that the release is accurate to the best of your knowledge and authorizes KnownAndSeen to submit it for distribution. Approval may affect your cancellation and refund eligibility as explained in our Refund Policy.

8. Delivery and reporting

The estimated delivery time for our press release distribution services is 2 to 5 days after you approve the final press release and it is submitted for distribution. Publisher review, network availability, weekends, public holidays, technical events or requested corrections may affect publication timing.

Your electronic deliverables include a PDF statistics report and a direct live URL for every publication confirmed by the distribution network, allowing you to open and view each published press release.

Our team also provides instructions explaining how to use the traffic-tracking method available for your campaign so that you can monitor the traffic being generated in real time. Tracking depends on the data and technology available for the purchased distribution service. Third-party figures may be estimated, delayed, revised or unavailable for some placements.

9. Third-party networks and editorial control

KnownAndSeen uses third-party distribution networks, publishers and technology providers. Each publisher or network may apply its own editorial standards, content restrictions, schedules and technical requirements.

Unless expressly guaranteed in writing as part of a purchased package, displayed media names represent possible distribution destinations and do not guarantee placement with any individual outlet. KnownAndSeen is not owned by, endorsed by or directly affiliated with those outlets unless expressly stated.

10. No guarantee of commercial results

We do not guarantee a specific number of readers, impressions, views, clicks, sales, leads, backlinks, search-engine rankings, media interviews or independent editorial coverage. Publication availability and duration may be controlled by third-party publishers.

Examples, previous results, real-time tracking data and reporting samples are informative or illustrative and do not promise the same outcome for another customer.

11. Your representations and responsibilities

You confirm that all information and materials you provide are accurate, lawful and not misleading, and that you have the permissions needed to use and distribute them. You remain responsible for substantiating factual, comparative, medical, financial, performance or other claims contained in your release.

You must promptly notify us if information changes before distribution. You are responsible for the consequences of inaccuracies that you supplied or approved.

12. Prohibited content and activities

You may not use our services for content that is unlawful, deceptive, defamatory, fraudulent, infringing, threatening, hateful, sexually exploitative or designed to manipulate markets, identities, reviews, traffic or engagement.

You may not submit content that violates intellectual-property, confidentiality, privacy or publicity rights; impersonates another person; contains undisclosed fabricated testimonials; promotes prohibited goods or services; or makes claims that cannot reasonably be supported.

13. Refusal, suspension and cancellation

We may request evidence or revisions, refuse content or suspend an order when we reasonably believe it violates these Terms, applicable law, payment-provider requirements or distributor editorial policies.

If an order cannot proceed because of customer-supplied prohibited content or refusal to make necessary corrections, refund eligibility is determined by the stage reached under our Refund Policy. We may cancel and refund an order when we determine that we cannot provide the purchased service.

14. Intellectual property

You retain ownership of your pre-existing names, trademarks, logos, photographs, documents and other materials. You grant KnownAndSeen and the relevant distribution providers a non-exclusive license to use, reproduce, format, transmit and publish those materials solely as reasonably necessary to perform the purchased service.

You are responsible for obtaining licenses and permissions for all customer-supplied materials. Subject to full payment, you may use the final press release prepared for your order for your lawful business purposes.

15. Refunds and payment disputes

Cancellations and refunds are governed by the Refund Policy, which forms part of these Terms. Service fulfillment is described in our Service Delivery Policy. Approved refunds are returned to the original payment method.

If you believe a charge is incorrect or a service has not been delivered, contact customer service first so we can investigate promptly. This request does not remove any rights available under applicable law or card-network rules.

16. Service availability and events outside our control

We may update, maintain or temporarily interrupt parts of the website or service. We are not responsible for delays or failures caused by events reasonably outside our control, including publisher outages, distribution-network interruptions, internet failures, governmental action, natural events or widespread service disruptions.

If such an event prevents a material part of the purchased service from being delivered, we will work with you on a reasonable correction, replacement, rescheduling or applicable refund.

17. Disclaimer and limitation of liability

Services are provided with reasonable care and skill. To the maximum extent permitted by applicable law, KnownAndSeen is not liable for indirect, incidental or consequential losses, loss of anticipated profit, or business outcomes that were not expressly guaranteed.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for fraud, fraudulent misrepresentation, intentional misconduct or mandatory consumer rights. Where liability may lawfully be limited, KnownAndSeen’s aggregate liability arising from an order will not exceed the amount paid for that order.

18. Applicable law and dispute resolution

If you are acting as a consumer, you retain the mandatory consumer protections available under the laws of the country where you habitually reside. For Clients acting for professional or business purposes, these Terms are governed by French law, without prejudice to any mandatory rules that must apply.

Before beginning formal proceedings, the parties agree to contact one another and allow a reasonable opportunity to resolve the matter informally. If a dispute cannot be resolved, jurisdiction will be determined under the applicable mandatory rules and, where legally permitted for a business Client, by the competent courts of France.

19. Changes to these Terms

We may update these Terms to reflect changes to our services, providers or legal obligations. The updated date will appear at the top of this page. Unless required by law, changes apply to future orders and do not retroactively change the material terms of an existing paid order.

20. General provisions

If any provision is found unenforceable, the remaining provisions remain in effect. A delay in enforcing a provision does not waive the right to enforce it later. These Terms, the package description, the order confirmation, the Refund Policy and the Service Delivery Policy form the agreement concerning the purchased service.
